Our clients came to us and wanted to enquiry on an offshore partner visa. The visa applicant holds Chinese passport and had a visitor visa refused.

The visa applicant and the Australian Sponsor met in China and have maintained a genuine relationship primarily through online communication. They were not yet married, had not registered their relationship, and had very limited evidence of cohabitation. While they planned to marry in the near future, they were not confident they could meet the requirements for a partner visa due to the limited supporting evidence available.

We developed a strategic approach to strengthen the application and confirmed to them that they don’t need to be married to apply for 309/100 visa and intention to marry can support the application.

  • Assessed eligibility based on the de facto relationship criteria.

  • Advised the clients on timing of marriage and how it supports relationship evidence

  • Prepared a comprehensive submission addressing the four pillars of relationship assessment (Financial, Nature of the household, Social recognition and Nature of commitment)

  • Structured evidence to show long-term communication and visits, future plans together including confirmed intention to marry and support from family and friends.

  • Drafted detailed relationship statements to clearly explain the timeline and commitment.

Not long after the application was submitted, the Sponsor went to China, and they got married in China. In about 10 months, we received a successful outcome without further request from Immigration.
