Case Study 02
Offshore Partner Visa
(Subclass 309/100)

Maria, a citizen of the United Kingdom, and Peter, an Australian citizen, engaged our services to assist with an offshore Partner visa (Subclass 309/100). Maria was residing in the UK while Peter was living in Australia. Their goal was to establish their life together in Australia with a pathway to permanent residency.

Maria and Peter met in London in 2021. Their relationship developed into a committed de facto relationship. Despite periods of long-distance, they maintained regular communication, visits, and shared long-term plans.

The key challenges in this case included managing long-distance relationship which requires strong evidence of continuity. They had limited joint financial documents due to offshore status, and Maria was also unable to relocate immediately to Australia due to family commitments in the UK. while Peter travelled periodically to spend time with her.

We advised Maria to apply for an Electronic Travel Authority sc651 visa before lodging the partner visa. This gives Maria the flexibility in case she comes to Australia she can apply for a Bridging visa A manually to continue staying in Australia while the visa application is in process.

We prepared a front-loaded application with relationship statements, communication records, travel history, third-party declarations and the evidence across all four relationship aspects. The application progressed smoothly without significant delays. Maria was granted the Subclass 309 visa and is now residing in Australia with Peter, progressing toward permanent residency sc100 visa.
