Jack, a citizen of Taiwan, was working in Australia as an ICT Business Analyst (ANZSCO 261111) on a Temporary Skill Shortage visa (Subclass 482). His current employer wished to sponsor him for permanent residency through the Employer Nomination Scheme (Subclass 186) under the Temporary Residence Transition (TRT) stream. Jack engaged our services to assist with his Subclass 186 visa application.

Jack understands the 186 in TRT stream requires the applicants to demonstrate at least 2 years of full-time employment in the nominated occupation. However, his employment history was not straightforward. Jack had worked for his first employer on a Temporary Skill Shortage visa (subclass 482) for approximately 18 months before leaving the role. He then had a gap of around four months, during which he travelled across Australia and undertook volunteer work assisting animals in a remote area. Following this period, Jack commenced employment with a second employer, also on a Subclass 482 visa. Given this background, Jack sought our advice on whether he could still meet the 2-year work experience requirement for the Subclass 186 TRT pathway, particularly considering the change of employer and the temporary break in employment.

We confirmed that his previous sponsored employment could be combined to meet the relevant work experience requirement.

​

As a holder of a Temporary Skill Shortage visa (subclass 482), Jack had up to 180 consecutive days following the cessation of his previous employment to either secure a new approved sponsor, apply for another visa, or depart Australia.

Although a visa may be subject to cancellation if this timeframe is exceeded, Jack secured employment with his current sponsor within the permitted period, and he remained compliant with his visa conditions.

We prepared the strong evidence including contracts, payslips and references. The Subclass 186 TRT application was approved without complications. Jack was granted permanent residency in Australia.
